Social Security Legal Guarantee

Since the beginning of this month, the social insurance law concerning pension, medical care, work-related injuries, childbearing, unemployment and many other new regulations has been formally implemented.

Professor Wang Xiangqian, director of the teaching and research section of the labor law of China Institute of Industrial Relations, said that the social insurance law is of great significance to the establishment of a social security system covering urban and rural residents, the protection of citizens' participation in and enjoyment of the legitimate rights and interests of social insurance, and the promotion of social harmony and stability.

Experts pointed out that the newly promulgated "social insurance law" has made clear the relevant contents, and the old-age insurance can be continued in different places. The payment period can be calculated in a nationwide scale, and the pfer procedure of pension insurance relations is more convenient.

If the insured employees are to move to the job market, they will be able to handle the relevant procedures only if they go to the new social insurance institutions or the social security institutions where their domicile is located.

The social insurance law stipulates that the social insurance administrative departments and the health administrative departments shall establish a settlement system for medical expenses in different places so as to facilitate the participation of the insured in the treatment of basic medical insurance.

The part of the insured's medical expenses that should be paid by the basic medical insurance fund shall be directly settled by the social insurance agency, the medical institution and the drug management unit.

In addition, the social insurance law also stipulates that the basic medical insurance relationship should be pferred to the individual in the area of overall planning for employment, and the accumulated years of payment shall be calculated.

The social insurance law clearly stipulates that employers do not pay work-related injury insurance premium according to law. If an industrial accident occurs, the employer shall pay the work-related injury insurance benefits. In addition, third workers will not pay for the medical expenses of the work-related injury or the third person can not be determined because of the third person's injury, and then the worker injury insurance fund will be paid first and then recover to third people.
