Procedures For Applying For Trademark Registration In China By Foreigners And Foreign Enterprises
According to the ninth and tenth provisions of the trademark law, a foreigner or a foreign enterprise applying for trademark registration in China shall be dealt with according to the agreement signed by its country or People's Republic of China or the international treaty jointly participated or in accordance with the principle of reciprocity.
If a foreigner or a foreign enterprise applies for trademark registration in China, it shall perform the following procedures: (1) submit a letter of attorney to the Trademark Office to apply for trademark registration by a trademark agency entrusted by the state.
The power of attorney shall be specified in the power of attorney, and the nationality of the principal shall also be specified.
If the power of attorney is written in foreign languages, a Chinese plation should be attached.
The signature of the trustor on the entrustment shall be signed by the president of the enterprise if the trademark registration applicant is a foreign enterprise; if the applicant is a foreigner, the foreigner will sign it.
(2) a letter of application for trademark registration was sent to the Trademark Office, and ten copies of the trade mark (the designated color coloured trademark should be delivered to ten copies of the coloring pattern) and one copy of the black-and-white ink.
The application for trademark registration shall be in Chinese.
(3) pay the application fee for trademark registration to the trademark office.
If the trademark is registered, it should also pay the registration fee.
